Hidden defects after buying a home in Spain
Handover dates, the cause of the problem and what you knew when buying are key.
Not every defect qualifies
Specific hidden-defect actions under the common Spanish Civil Code consider whether a significant defect existed at sale and was not readily apparent. Keep the property advert and seller’s statements.
Prepare a timeline
Record signing, key handover and when symptoms appeared. Retain contracts, photos and messages. An expert may establish whether the defect existed before purchase; discovery alone does not establish age.
Common Civil Code deadlines
The specific hidden-defect actions expire six months after delivery, not discovery. Do not assume any demand letter extends that period. Other actions may be available depending on the circumstances and require separate assessment.
Sales governed by Catalan law
These use the Catalan Civil Code’s conformity rules rather than automatically the six-month rule. Applicable law, contract date, manifestation of the defect and relevant deadlines must be reviewed. Location alone does not replace that assessment.
Before settling
Where possible, record damage and arrange assessment before repairs, while addressing emergencies. Check waivers before signing. Price reduction, termination or other remedies depend on the applicable route.
General information. The lawyer reviews your case, documents and deadlines before proposing action.
