Preparing to recover a property through the legal process
Unpaid rent, an expired lease and occupation without a contract are different situations. The documents help identify the appropriate procedure in Spain.
1. Gather property documents
Prepare the lease and amendments, a current land registry extract and your title. The lawyer will explain any additional registry documents needed.
- Lease, extensions and amendments.
- Land registry extract and title deed.
- Known property and occupant details.
2. Calculate rent arrears
List monthly amounts and received payments. Recovering possession and recovering money are distinct aims; the quotation should define the work included.
3. Follow the legal route
Do not change locks or cut utilities to force occupants out. Seek advice before accepting keys with waivers or conditions you do not understand.
What happens next
The lawyer checks prior requirements, prepares the appropriate claim and explains its stages. Timing depends on the court, service and circumstances; a recovery date should not be promised.
General information. The lawyer reviews your case, documents and deadlines before proposing action.
