Insurance refuses compensation: what to check before claiming
Review the refusal alongside the policy, facts and accident records. Different reasons for refusal require different responses.
Keep the full explanation
Retain the response, date and documents submitted. Distinguish a coverage refusal from disputed responsibility or disagreement over damage and amount. The evidence needed differs.
Review the full policy
Gather general and individual conditions, endorsements and payment records. An exclusion, monetary limit and excess are different. A cited clause needs review in context before deciding whether refusal is justified.
Document consequences
Organise accident reports, photos, estimates, invoices and relevant medical follow-up. Do not sign a release without understanding which losses it settles, even where a partial payment is offered.
Pre-action steps
A demand can set out facts, the payment or benefit sought and grounds for disputing refusal. The correct channel and prior steps depend on the policy and action. A customer-service complaint does not necessarily satisfy litigation requirements or resolve deadlines.
Independent legal advice
We check any legal-expenses cover and the circumstances and limits of lawyer choice. Do not assume full reimbursement without reviewing it. Describe the general issue first and agree how to provide the policy and reports.
