What to check before signing a contract in Spain

Before accepting a lease, property deposit agreement or payment settlement, check your obligations and what happens if circumstances change.

Identify the document and parties

Check who signs and in what capacity. The document’s title alone does not determine its effects. Gather attachments and earlier proposals and read the complete text.

Payments, dates and security

Check price, taxes or expenses, due dates, duration and renewals. Clarify the purpose and return conditions of any deposit or security. Not all Spanish property deposits or arras have the same effects.

Amendment and termination

Review notice periods, penalties, breach and waivers. Terms must comply with applicable law; signing does not always make a clause valid. Unfair terms in consumer contracts require specific assessment.

Record the agreed changes

Ensure agreed amendments appear in the final text and attachments before signing. Keep the complete signed version and payment records. Do not sign blank pages or unseen attachments.

What legal review provides

A lawyer can explain obligations, identify risks and propose amendments or draft a document from your agreed terms. Negotiation and attendance at signing are separately agreed. Review does not guarantee that a dispute can never arise.
