Preparing records for a possible medical negligence claim
A poor outcome alone does not prove negligence. Clinical records and a timeline help review what happened and whether an independent report is needed.
1. Request records from the centre
Request access to and a copy of relevant records. Keep the request and reply. Access is subject to legal limits, including third-party information.
- Consultation, emergency, surgery and discharge reports.
- Diagnostic tests and images.
- Consent forms and later treatments.
2. Organise dates and consequences
Record the centre, dates and changes in health. Gather expenses, sick leave and income loss records. Keep originals without alteration.
3. Distinguish public and private care
Explain where and under which arrangement you were treated. The party, procedure and deadlines may differ. The lawyer reviews the records before proposing action. Expert assessment is separately charged if needed.
Providing reports
Do not submit medical details through the initial form. Describe the general concern and agree a suitable way to provide records with the lawyer. Call if a deadline is approaching.
